    Legal Services of Greater Miami and its 30 lawyers have provided locally renowned legal representation to low-income communities for 55 years.  The firm has been recognized for its creative and aggressive advocacy for its clients.  

    Legal Services is seeking a full-time Florida licensed attorney (or pending July 2021 bar results) to work in its Low-Income Taxpayer Clinic (LITC) which is housed in its Health and Income Maintenance Unit.  The LITC Program was created to ensure the fairness and integrity of the tax system for taxpayers who are low income or speak English as a second language (ESL) by representing taxpayers in their disputes with the IRS, educating them on their rights and responsibilities as U.S. taxpayers and identifying and advocating for issues that impact these taxpayers.

    The candidate selected will evaluate cases presented by low to moderate income taxpayers and represent them before the IRS.   A sampling of cases includes examinations, audit reconsiderations, innocent spouse petitions, identity theft, return preparer misconduct, preventing/stopping levies, releasing/withdrawing liens, recommending and submitting collection alternatives, such as, offers in compromise and installment agreements, appeals, preparing Tax Court petitions and participating in calendar calls and settlement events to assist pro se taxpayers.

    The attorney will analyze and review changes in tax laws and regulations with emphasis on changes impacting low income and ESL taxpayers.  The attorney will conduct outreach and community education to taxpayers and service providers to build awareness and knowledge of tax benefits and credits available to low income and ESL taxpayers.  The successful candidate will be on track to become the LITC Director and will be asked to assist with grant reporting requirements.

    The attorney will maintain his or her own caseload and will also be required to conduct client intake and potentially spearhead a special project or clinic.

    To achieve great outcomes for our clients and to maintain our respected reputation with the Tax Court and the LITC community, we are seeking an attorney with a commitment to, and passion for, the rights of low-income clients. The salary is commensurate with experience and depends on years of general and specialized practice.  Our comprehensive fringe benefits package includes paid holidays, paid vacation (15 days per year, which after two years, increases to 20 days per year), sick leave (12 days per year), and five additional leave days.  Full-time employees may participate in our benefits program on the 1st of the month following the date of hire.     Attorneys in the Tenants’ Rights Unit represent tenants facing eviction, file affirmative actions against slumlords to ensure a tenant has decent, safe housing, and ensure tenants have access to and can keep rental subsidies. Attorneys in the Unit litigate in state and federal courts, administrative proceedings, and appellate courts. The attorney would be responsible for his or her own caseload and the attorney’s duties will include interviewing clients, drafting pleadings, conducting depositions, negotiating with opposing parties, and representing tenants in court. This project involves significant litigation; however, the attorney would also be required to conduct client intake, conduct home visits, conduct education workshops for tenants, work with pro bono attorneys, complete administrative tasks, and participate in client outreach.

    Legal Services of Greater Miami, Inc., (Legal Services) is accepting applications from attorneys admitted to the Florida Bar who have a commitment to and passion for the rights of low-income clients and older adults.  In addition to providing legal representation to older adults who reside in nursing homes and other institutional settings, the attorney will work with a team of lawyers and advocates from across Florida to develop strategies to increase access to legal services by nursing home residents and older adults.  The attorney will handle his or her own caseload and will be required to conduct client intake on the telephone, in-person and in the community. The attorney will be required to develop and participate in community outreach events, conduct client and provider education events, and collaborate with client and community partners. 

    The attorney must be trained, or be trained, in nursing home discharge cases, Medicaid for long-term care, ethical issues relevant to representation of older adults, and other issues unique to people over 60.  The attorney must comply with funder requirements, collaborate with partners, and participate in professional activities in furtherance of Legal Services’ mission.  Must accept supervision and other duties as assigned.
