    Responsibilities

    The Associate General Counsel and Director of Labor Relations (AGC) represents the Florida A&M University Board of Trustees (FAMU) in all legal proceedings in State and Federal Courts, and various administrative agencies of Federal and State Government. The AGC shall be familiar with administrative operations of the University.  This responsibility includes the preparation of all pleadings associated with Federal and State court litigation and all other proceedings before courts or agencies.  The AGC is also responsible for the preparation and/or review of most documents or instruments of legal character, e.g., contracts, leases, bid specifications, letters of agreement, and the like, in all areas of the University operations, including academic program administration, administrative affairs, student affairs, and University direct support organizations.  The AGC participates in the review, preparation, interpretation, and implementation of a wide range of institutional policy statements, regulations, rules, and opinions, including those related to the use of University facilities, and rules regarding ownership of and rights in materials subject to copyright or patent.  The AGC is otherwise responsible for the interpretation of the State and Federal laws, rules and regulations; and the rules and regulations of the Board of Governors and Board of Trustees, insofar as they affect any internal operation of the University.  The AGC is responsible to advise key University officials regarding the application of said laws, rules and regulations.

    In this position, the AGC shall provide legal advice and services on a wide variety of legal matters for FAMU and affiliated entities with a primary emphasis on:  labor and employment, human resources, employment matters related to academic units, investigations, training, and dispute resolutions, including, without limitation represention of FAMU in litigation, grievances, mediations and arbitrations, in administrative and court proceedings; collective bargaining matters; immigration matters; civil rights, equal employment and ADA matters; and employment contracts.  The AGC will assist outside counsel retained on behalf of FAMU.  The AGC will also be responsible for legal and regulatory aspects of University compliance matters, for conflicts of interest and ethics opinions/matters, and for the development of policies, regulations, and rules in labor and employment, and other division, department and program specific policies. Additionally, the AGC will assist with student and academic affairs related litigation.

    The AGC shall also: Manage the labor relations program for the University by analyzing the collective bargaining agreements and developing interpretation of intent, and terms of contract to counsel management in the development and application of labor relations policies and practices; prepare reports of the types and frequency of actions taken concerning grievances, arbitrations, mediations, and related labor relations activities to identify problem areas as required; verify adherence to terms of labor contract by monitoring day-to-day implementation of policies concerning wages, hours, and working conditions; represent FAMU in labor contract negotiations or serve as resource to negotiators by providing information on provisions of current contracts and the significance of proposed changes; furnish reference documents and statistical data concerning labor legislation, labor market conditions, prevailing union and management practices, wage and salary surveys, and employee benefits programs for labor contract negotiations; apprise the Board of Trustees and central administrative officers of the application of State and Federal laws, rules and regulations, and the rules, policies, procedures and regulations of the Board of Trustees and the Board of Governors impacting University operations concerning employment and labor matters; serve as Step Two Reviewer, as appropriate and needed; assist outside counsel as appropriate in labor relations matters; and Perform other related duties as assigned by the President or the General Counsel and Associate General Counsel (Deputy).

    Minimum Qualifications

    A J.D. degree from an ABA Accredited Institution; member of the Florida Bar in good standing; actively engaged in the practice of law for a minimum of two years as a licensed attorney.

    This is an Administrative and Professional (A&P) position.

    THE MUNICIPAL GOVERNMENT

    The City Charter prescribes that Hollywood operate under the Commission/Manager form of government. Policy-making and legislative authority are vested in the City Commission, which consists of a Mayor and six Commissioners. The Mayor is elected at-large, and the Commissioners are elected by district on a non-partisan basis to four-year concurrent terms.

    The Commission is responsible for, among other things, passing ordinances, adopting the budget, approving labor contracts and expenditures, appointing committees and hiring the City Manager and City Attorney.  The City Manager is the final appointing authority for all other City employees and is responsible for exercising control over all Departments and Offices. The total Budget for Fiscal year 2020 is $567,542,781 and there are 1,305 full-time City employees including Police, Fire, Public Works, and a regional Public Utility.

    THE DEPUTY ATTORNEY

    Under the administrative direction of the City Attorney, the Deputy Attorney provides assistance to the City Attorney through management of administrative details of the City Attorney’s office and special projects, as directed by the City Attorney.

    The Deputy Attorney performs the duties of Acting City Attorney during the City Attorney’s absence and performs the duties and activities to which attention must be given.

    Exposure to toxic chemicals is linked to chronic diseases and health conditions, many of which are on the rise as toxic exposures have increased. The goal of the Toxic Exposure & Health Program is to use litigation and other legal advocacy to ensure that all people have safe workplaces and neighborhoods, access to safe drinking water and food, and live in homes that are free of hazardous chemicals. In recent years, attorneys doing this work have won a groundbreaking lawsuit requiring EPA to improve its lead hazard standards, successfully petitioned the Consumer Product Safety Commission to ban a toxic class of flame retardants in consumer products, prevailed in a challenge to rules that would have allowed EPA to ignore the risks posed by legacy uses of toxic substances, such as lead in drinking water pipes, when it conducts chemical risk evaluations, and sued the United States Department of Defense for incinerating the dangerous and persistent chemicals known as PFAS without environmental review.

    We expect the staff attorney we hire for this position to play a leading role in developing and leading litigation and seeking opportunities to further the Program’s work using litigation as well as other forms of legal advocacy. The ideal candidate for this position will have experience with all aspects of complex litigation—including developing cases, motion practice, evidentiary hearings, oral argument, and appeals. Prior experience with environmental law is not required, but prior experience with administrative law, as well as a demonstrated capacity to work effectively in a public-interest environment, is strongly preferred. While a science background is not required, candidates should be comfortable reading and working with scientific material.

    The Staff Attorney’s time will be spent on substantive case/legal matter work (70%), supervision/mentoring (20%), and administrative matters (10%).

    Our cases typically involve substantive claims arising from environmental, administrative, or civil rights laws. But winning those cases often depends on successful advocacy concerning “non-substantive” doctrines such as standing, finality, deference to agency decisionmaking, and federal remedies. In recent decades, we have seen concerted attempts to influence these doctrines in ways that limit our clients’ ability to vindicate their legal rights to a healthy environment, transparent government, and justice under the law.

    Our Director of Strategic Legal Advocacy will help our 150-lawyer team identify and counter these doctrinal trends in the context of our ongoing substantive work. The Director will serve as a resource for monitoring relevant legal developments, as a thought partner for teams confronting relevant doctrinal issues in their matters, and as lead counsel in impact litigation where appropriate. While the Director will focus primarily on Earthjustice’s own advocacy, we anticipate that they will routinely work with Earthjustice’s peers in the broader progressive legal community.

    The Director will be the first member of a team that we plan to expand over time. We expect the Director to hire an additional attorney to the team by June 2021, and to hire additional staff by June 2022. These plans are contingent upon Earthjustice’s fundraising efforts.

    The Director will report to Earthjustice’s Senior Vice President of Programs, who supervises Earthjustice’s litigation and lobbying teams.

    Responsibilities:

    Litigation strategy, support, and leadership – 90%

    Develop systems and partnerships to track legal trends in administrative, procedural, and access to justice issues that impact Earthjustice’s ability to pursue substantive environmental law claims;
    Serve as a resource to Earthjustice attorneys to improve our written and oral advocacy on strategically important administrative and procedural issues;
    Develop systems and partnerships to identify opportunities for impact litigation on administrative and procedural issues, including matters where amicus participation is may be warranted, and

    Develop new cases in a strategic fashion; conduct factual investigations; develop legal theories; draft pleadings and briefs; and otherwise manage new and existing cases within state and federal courts and administrative agencies.
    Litigate cases from beginning to end, performing all aspects of litigation.
    Develop and maintain partnerships with clients, allies, and coalition partners in litigation and other advocacy.
    Collaborate and manage relationships with co-counsel, clients, and coalition partners.
    Supervise the work of Associate Attorneys, Litigation Assistants, and Law Clerks.
    Integrate communications and legislative advocacy into litigation and other legal strategies, working effectively with other departments within Earthjustice, including Communications, Development, and Policy and Legislation.
    Support efforts to ensure a diverse, equitable and inclusive work culture that encourages and celebrates differences.
    Qualifications:

    Lawyer who is admitted or willing to apply for admission to the Texas bar;
    At least five years of litigation experience;
    Excellent litigation skills, including proven legal research, writing, analytical, and oral advocacy skills, and ability to manage a litigation docket effectively;
    Strong skills in communicating litigation and advocacy goals and messages to the media;
    Ability to work independently and in collaboration with client partners and in leading a team;
    Strong and demonstrated initiative, good judgment, creativity, and work ethic;
    Ability and willingness to travel as needed for case work, court appearances, and presentations;
    Commitment to serving the public interest, and a passion for the role of Earthjustice and its mission;
    Demonstrated awareness and sensitivity to the needs and concerns of individuals from diverse cultures, backgrounds, and orientations;
    Commitment to help create a diverse, equitable, and inclusive work culture that encourages and celebrates differences.
    Salary range is based on experience and location
    Salary range in New Orleans, LA or Texas (remote) with 5+ year's legal experience: $118,150+
