    The Associate Attorney program comprises a two-year position with a possible extension for a third year. This program is designed to help attorneys develop into thoughtful, professional, and effective advocates skilled in the various phases of public interest litigation. Many associates have gone on to other positions within Earthjustice or with other public interest organizations.

    Responsibilities:

    The Associate Attorney will generally work collaboratively with senior Earthjustice attorneys, but is expected to work more independently over time. Associate attorneys perform a range of litigation and advocacy-related tasks that can include:

      ·         Conducting factual investigations and legal research, and preparing memoranda on issues relating to ongoing or potential new cases.
      ·         Drafting motions, briefs, and other pleadings.
      ·         Participating in proceedings before federal and international courts and tribunals.
      ·         Working with clients and experts, and learning how to handle press work.
      ·         Hiring and supervising law students who work at Earthjustice as interns or clerks.
     

    Qualifications:

    • Law school graduate admitted to, or willing to apply for admission to, the California State Bar.
    • Up to 7 years of experience.
    • Excellent research, analytic, writing and communication skills.
    • Strong work ethic, initiative, sound yet creative judgment.
    • Strong desire to fight for the right of all to a healthy environment.
    • Ability to work well in a team-oriented atmosphere.

     FIU College of Law is seeking applications for adjuncts to teach Legal Skills & Values III for the Fall 2017 semester and future semesters.  To provide a little more background, the FIU College of Law Legal Skills and Values Program consists of two required courses in the first year of law school (LSV I and LSV II) and an additional required course by the end of a student’s fourth semester of law school (LSV III).

    Lead the University’s transactional practice, draft and review a wide variety of contracts, affiliation agreements, leases and other transactional documents.   Advise clients on recommended changes and draft language consistent with the University's position.  Provide consultation to campus clients on a wide variety of legal issues such as copyright, intellectual property, real property, landlord tenant issues, Title IX investigations, privacy, student conduct, sponsored research, leaves of absence, ADA, employee discipline, compliance and other matters.     This position may require occasional evening and weekend work hours.  It may require providing own transportation to travel to off-campus meetings.

    Qualifications:

    Required: J.D. from ABA-accredited school with superior academic achievement and member in good standing of the California State Bar (or membership in another state bar with eligibility to obtain membership in the California Bar within a reasonable period of time after hire). Substantial experience performing tasks related to the primary functions of the position in a college or university or for college or university clients. In-depth knowledge of institutional structures, policies, regulations, and procedures in higher education. Outstanding legal writing and research experience.     Immediate opening for a health care attorney in the Office of the General Counsel at Stanford University. This is a full time position, but we are open to considering somewhat less than 100% FTE.

    The position provides the first-line legal support to the Stanford University School of Medicine and may also involve advising Stanford Health Care and Lucile Packard Children’s Hospital at Stanford. The position reports directly to the General Counsel.

    Responsibilities include legal support in some or all of the following areas: health care, academic issues, business and transactional matters, compliance with applicable federal and state laws and regulations applicable to a major academic medical center (including responses to external agencies, conflict of interest issues, human subjects research, research animals, and scientific misconduct), recruitment, compensation, and setting reimbursement for faculty physicians; and legal advice on insurance coverage and risk management.

    This position will also serve as the ex-officio nonvoting member to the university’s eight Institutional Review Boards for human subjects research, including Stem Cell Research Oversight, and one Institutional Animal Care and Use Committee and will provide various ad hoc reviews of compliance matters related to these committees. This person would consult with the Vice Provost/Dean of Research Office on issues related to compliance with university research policies and intellectual property and technology licensing policies and issues.

    The position requires discretion, flexibility, and the ability to understand and manage projects with competing interests in a constantly changing, cutting-edge environment. Must be able to work independently, while also partnering and working with outside counsel and other staff attorneys to manage a varied and sometimes heavy flow of work.

    The position of the Associate University Counsel for Health Affairs (Counsel) is an important role within the University of Florida (UF) Office of the Vice President and General Counsel (OGC), reporting directly to the UF Deputy General Counsel for Health Affairs (UF Deputy/HA) and working closely with the Senior University Counsel for Health Affairs and Contracts Unit Director (Sr. Counsel/Contracts Director), UF Senior University Counsel for Health Affairs (Sr. Counsel/HA), and other OGC leadership. The Counsel will provide legal services and advice in a variety of subject areas to the deans, colleges, centers and institutes of the UF Gainesville and Jacksonville Health Science Centers (HSCs), the colleges’ practice plans and other private entities affiliated with UF and supporting the faculty or activities of the HSCs.  Such services are also anticipated to be provided to UF’s affiliated clinical enterprise, including, as needed and agreed with UF Health Shands Senior Vice President and General Counsel (Shands SVP/GC), its academic hospitals.  The UF HSCs and their affiliated UF Health Shands academic hospitals and other affiliated health affairs entities participate in a close collaboration called “UF Health” and have strong mission alignment with UF. This position is anticipated to be based in Gainesville, but will provide services to both Jacksonville and Gainesville HSCs and across the UF Health endeavor, as needed and assigned by the UF Deputy/HA or UF Vice President and General Counsel (UF VP/GC).  This position will coordinate and communicate closely with the UF Deputy/HA, but will be expected to work with a significant degree of independence on day-to-day matters related to Institutional Research Board (IRB), Institutional Animal Care and Use Committee (IACUC), Institutional BioSafety Committee (IBC), Material Transfer Agreements (MTAs), public records, subpoenas, clinic consent issues, research billing compliance.  This position will also provide expertise and work on other health affairs and related academic, research and business legal matters as needed and assigned by UF Deputy/HA.

    To fulfill his or her role, the Counsel must effectively perform his or her duties to high standards of substantive legal and behavioral competence, as evaluated by the UF Deputy/HA under the following OGC principles: client service, collaboration, professionalism, accountability, sustainability and integrity. The Counsel must demonstrate a positive, context-sensitive, and productive working relationship with the leadership of the HSCs and other components of UF Health, and close partnership with the Deputy General Counsel of Shands Teaching Hospitals and Clinics, Inc., the Vice President and Senior Counsel, Legal Affairs of the Shands Jacksonville Medical Center, Inc., other Shands entity lawyers and OGC colleagues.  The aim of this close partnership is to further the success of UF Health and realize strength and the greatest benefits for “One UF,” meaning all of UF and its family of affiliates including all in the UF-related health affairs enterprise, aligned in support of UF’s mission.  The Counsel will work closely with the UF Deputy/HA, Sr. Counsel/HA, Sr. Counsel/Contracts Director, other contracts lawyers, and Shands lawyers to maximize the synergies and making legal expertise a competitive advantage for the entire UF Health endeavor.  

    The Counsel must have knowledge of, and a high level of expertise in, most (if not all) of the following areas and will demonstrate the ability to acquire expertise in the remaining areas that affect academic health centers and medical colleges, faculty, residents, staff, and students: health affairs policy and legal advice to IRB, IACUC, and IBC on related regulations and laws (e.g., federal and state health care privacy, including without limitation HIPAA/HITECH), academic, faculty, student and resident affairs, clinical and research matters, fraud, waste, and abuse laws, Medicare and Medicaid reimbursement regulations, tax codes, restrictions related to exempt organizations, scope of practice and public records.

    This position is designed to furnish a high level of professional legal service in the area of health law to the Health Science Center colleges at the University of Florida. In addition to handling general legal matters such as subpoenas and public records requests, Counsel will advise University officials on legal aspects of policy, will handle legal issues for the Health Science Center colleges as assigned, but primarily in the areas of physician billing compliance, human subject research, animal research, HIPAA, HITECH, and research billing.  This position plays a significant role in preventing avoidable risks and mitigating unavoidable risks arising in all areas of research, billing, and privacy. This position works with leadership and staff in the Office of Research and the HSC. Counsel will also interact with members of the legal profession, officials of state and federal government, and others as required to perform the duties and responsibilities.

    Preferred Qualifications

    The person holding this position must possess a JD or L.L.B. degree from an ABA-accredited law school and have a minimum of 5 years of experience practicing law, with considerably more experience being appropriate.  This position is equivalent to that of a junior partner or more senior lawyer in a private law firm and would be appropriate for lawyers with significantly more experience than the minimum.  This position must also have excellent operational, project management, change management, and administrative skills, analytical ability, writing skills, listening and oral communications skills, diplomacy, finesse and interpersonal skills, and well developed, excellent judgment and skill in when to be appropriately assertive or adversarial, when to be deferential or conciliatory, in garnering consensus, and in distinguishing between high and low priority legal issues.  Training and marked accomplishment in an excellent private law firm or in the law office of, or representing, a large university, hospital or health system, or tax-exempt organization are helpful, as is experience in or representing the public sector.  A deep and sophisticated level of substantive expertise in the primary areas relevant to the responsibilities of the position (including regulatory matters and litigation and/or transactional work in the health affairs context is required, and it is a plus if including experience on behalf of, an academic health center, faculty practice plan, clinic and other entities for which this position is responsible.   The ability to support good management, efficient and effective operations, and appropriate change are critical.  Enthusiasm for the academic, research and service mission of great academic institutions is essential.

    Required Licenses. Certifications, and Other Specific Requirements of Law

    The person holding this position must be a member of the Bar of a state within the United States and, if that state is not Florida, must become a member of Florida Bar as soon as reasonably possible, and, in any case, not later than 9 months of employment (unless otherwise approved by the University).  Bar membership must be maintained in good standing.     STAFF ATTORNEY POSITION

    American Civil Liberties Union of Florida, Tampa Office 

    The American Civil Liberties Union Foundation of Florida (ACLU-FL) invites applications for the full-time position of Staff Attorney in its Mid-Florida Regional office based in Tampa, FL. Specifically, we are looking for someone to advance the organization’s legal advocacy in core civil liberties and civil rights areas, though the person also will be expected to develop and lead the ACLU of Florida’s legal work on behalf of immigrants’ rights. The staff attorney will be a member of the Legal Department, working under the supervision of the Legal Director.

    OVERVIEW

    The ACLU-FL, the state’s largest civil rights and civil liberties organization, is a not-for-profit, nonpartisan organization that employs litigation, public policy advocacy, and public education to protect and promote a broad range of constitutional issues and individual rights, such as freedom of speech, racial justice, right to privacy, religious liberty, criminal justice reform, voting rights, reproductive rights, LGBT rights, disability rights, and immigrants’ rights. The ACLU-FL is an affiliate of the national ACLU which implements its vital civil liberties mission in all 50 states in large part through affiliate entities such as the ACLU-FL. Operating out of four offices in Miami (main), Tampa, Pensacola, and Jacksonville, the Florida affiliate has 25 staff members, placing it among the larger ACLU affiliates in the nation.

    The ACLU-FL litigates a broad range of complex constitutional cases in federal and state courts through direct representation, filing amicus briefs, and submitting administrative complaints to state and federal agencies. The staff attorney, who will be based in the ACLU’s Mid-Florida Regional Office in Tampa, will be primarily responsible for developing new cases and litigation strategies, and must be able to work both independently and as part of a statewide litigation team.

    ROLES AND RESPONSIBILITIES

    • Litigate cases in state and federal courts. This includes working and co-counseling with cooperating attorneys; conducting extensive research and factual investigations; writing motions, briefs, and other court filings; court appearances; and oral arguments.
    • Identify and develop new cases and litigation strategies in the ACLU-FL’s programmatic priority areas.
    • Supervise volunteers, student interns and legal fellows.
    • Support and promote the work of the organization on ACLU priority civil rights/civil liberties issues.
    • Participate where appropriate on relevant task forces and coalitions.
    • Work closely with the ACLU-FL’s Public Policy, Advocacy and Communications departments in helping to advance the ACLU’s public policy objectives.
    • Assist in developing and writing advocacy materials, including blog and media materials.
    • Engage in public speaking and articulate ACLU policies and programs to the public and the media on a broad range of issues.

    EXPERIENCE AND QUALIFICATIONS

    • J.D. degree and a minimum of five years of litigation experience required. Preference will be given to candidates with significant experience in the area of immigrants’ rights. Responsibilities will be commensurate with experience and demonstrated skill level.
    • Member of Florida Bar or admission within one year of starting position.
    • Excellent analytic, legal research, factual investigation, and writing skills.
    • Ability to synthesize complex issues and communicate them effectively to diverse audiences, including: elected officials, attorneys, advocates, impacted communities, supporters, the media, and the general public.
    • Proven project management and organizational skills, including the ability to work independently, attention to detail, and the ability to meet deadlines while under pressure.
    • Ability to work collaboratively and in team settings is essential.
    • Ability and willingness to travel around the State.
    • Demonstrated commitment to civil rights/civil liberties, and the mission and goals of the ACLU.
    • Fluency in Spanish is a plus, but not required.

    COMPENSATION

    The ACLU-FL offers a salary which is comparable to other public interest law firms in the area and will be set depending upon the person’s level of experience.
