    Earthjustice’s Staff Attorneys are experienced attorneys who develop, file, and litigate cases on behalf of our clients that align with the programmatic goals and regional needs of the office in which they work. We compensate our Staff Attorneys in lockstep based on their geography and years of legal experience; some have as few as six years of litigation experience and others have been with us for decades, and many are nationally-recognized leaders in their fields.

    Earthjustice’s Northeast Regional team is based in New York City. The team focuses on carrying out Earthjustice’s mission in the Northeast Region and beyond to address climate change and protect environmental health. In recent years, Staff Attorneys from the office have secured victories that led to a state-level ban on fracking, won a groundbreaking lawsuit requiring EPA to improve its dust lead hazard standards, prevailed in a legal challenge to a weak state water permit for industrial dairies, and obtained an order requiring EPA to timely rule on discrimination complaints after it had ignored some for decades. Attorneys in the office currently are pursuing a wide range of cases to leverage the momentum in the region to slash greenhouse emissions by stopping the development of costly and dangerous fossil fuel infrastructure and pushing for an equitable transition to a zero-emissions future. The Northeast regional team also is fighting to protect the health of local communities from threats such as dangerous chemicals in drinking water, lead in household dust, and air pollution from incinerators and gas plants. In partnership with environmental and social justice groups, the team seeks to further develop its representation of communities to better serve overburdened populations in the Northeast region. The Office also has increased its New York State legislative advocacy efforts.

    We expect the Staff Attorneys we hire for this position to play a leading role developing and litigating cases and seeking regional legislative opportunities to further the Office’s work. Both Staff Attorneys will play an integral part in shaping the Northeast Office’s strategic plan for fulfilling our regional mission. Both Staff Attorneys also will play an important part in helping our less-experienced attorneys and professional staff grow and develop in their careers.

    The Staff Attorneys’ time will be spent on substantive case/matter work (70%), supervision/mentoring (20%), and administrative tasks (10%).

    Responsibilities

    Develop cases and legal advocacy strategies to support organization and office goals.
    Litigate cases from beginning to end, taking the lead on all aspects of litigation.
    Work with Earthjustice lobbyists and coalition partners to advance legislative and other advocacy strategies.
    Supervise the work of associate attorneys, interns, and litigation assistants.
    Cultivate new allies and engage in partnerships with and representation of community groups.
    Collaborate and manage relationships with co-counsel, clients, and coalition partners.
    Serve as spokesperson for Earthjustice and, where appropriate, clients.
    Work collaboratively and effectively with colleagues throughout Earthjustice, including Litigation, Communications, Development, and Policy and Legislation.

    Job Description

    Position Summary:

    This position is responsible for assisting with the oversight of pre-litigation and litigation claims against all brands. Provides day-to-day legal guidance and support to the Crew Medical Department, closely working with them to ensure compliance with the company’s maintenance and cure obligations under general maritime law and the terms set forth in the Collective Bargaining Agreements. This position is also responsible for providing legal support to the Injury Prevention, Security and other departments within the corporation concerning issues relating to crew claims or other related matters.

    Essential Duties and Responsibilities:

    1. Assists the Director, Crew Claims & Litigation with the oversight of crew claims and crew litigation matters for all brands. 
    2. Provides guidance and instruction to adjusters in evaluating and negotiating claims for pre-suit settlement discussions directly with claimants and claimant’s attorneys for all brands. 
    3. Provide instruction to claims adjusters and individuals within the crew medical department regarding crewmembers’ entitlements to maintenance and cure benefits and disability benefits in accordance with general maritime law, collective bargaining agreements and other laws. 
    4. Work with crew medical case managers to identify claims that may be suitable for direct settlement with crew members, in order to negotiate settlement prior to the crewmember’s retaining of legal representation. 
    5. Provide oversight of the Company’s Workers’ Compensation claims, as well as claims arising from the FIU Dance Studio.
    6. Responsible for assisting with the management of outside legal counsel and provides guidance regarding case management on crewmember cases in litigation. 
    7. Serve as the company’s corporate representative at trials, arbitrations and depositions; testifies on behalf of the company regarding the company’s policies, procedures, and actions relating to hiring practices, pre-employment medical examinations, shipboard training, disciplinary processes, investigations of accidents and incidents, and the provision/administration of maintenance and cure benefits. 
    8. Provide litigation support to internal and external legal counsel with discovery, investigation, and trial preparation.
    9. Attend conferences with insurance companies and P&I Clubs to analyze claims for accurate reserve setting and discuss litigation strategies for claims.  Conduct trend analysis, evaluations of loss history, identification of liabilities and/or potential risk recurrence, and works in an advisory role with other departments, such as Safety and Security to recommend risk and loss prevention measures. 
    10. Partners with management in other departments within the organization to create and implement policies/best practices in order to reduce the potential for claims and litigation presented by crewmember incidents, accidents, and medical conditions.

    Job Requirements

    Qualifications:

    • Bachelor’s degree and J.D. degree from an accredited law school is required.
    • Minimum of five (5) years legal experience in the field of Admiralty Law and Employment/Labor Law.
    • Passed the Florida Bar Examination. 

    Knowledge and Skills:

    • Must be able to travel both domestically and internationally to conduct ship inspections, attend settlement conferences, and for other circumstances that may arise. 
    • Excellent verbal and written communication, negotiation, and presentation skills.
    • Effectively articulate the company’s position when testifying as the corporate representative.
    • Extensive knowledge of the General Maritime law, Admiralty law, and employment law. 
    • Must have strong negotiation, facilitation and consultative skills with the ability to interact effectively with all internal and external business partners.

    Earthjustice is seeking an experienced litigation attorney to join its Midwest Regional Office in Chicago, IL. This office serves as a focal point for work throughout the Midwest, potentially including work across the full array of Earthjustice’s program areas - Climate & Energy, Healthy Communities, Lands and Wildlife, and Sustainable Food and Farming. The Supervising Staff Attorney will independently develop, file, manage, and litigate cases from beginning to end, and will work with the Managing Attorney to develop strategic objectives, set priorities, build and maintain client and partner relationships, and assess resource needs. This person will also supervise the work of other staff assigned to the Midwest Regional program (potentially including Associate Attorneys, Fellows, Litigation Assistants, and litigation support staff).     The Supervising Staff Attonrey will play a leading role in their own docket of major environmental cases, collaborate on litigation with other Earthjustice attorneys and staff, and develop and maintain relationships with clients and partners (such as, other nonprofit organizations, environmental justice groups, community-based organizations, labor unions, and tribes). This person will also serve as a thought partner with the Managing Attorney and a Litigation Leader in the office. It is particularly important that the incumbent be a seasoned litigator with experience leading and developing their own cases, and the ability to do so at Earthjustice from day one.

    Our practice increasingly emphasizes a mentorship culture for staff at all levels, and we expect that every staff attorney will help nurture the development of early career attorneys and other staff. Supervising Staff Attorneys also supervise more junior staff in connection with their work on particular projects, and will be asked to serve as the formal supervisor for one or more members of the junior staff.

    Responsibilities:

    Manage new and existing cases from start to finish, performing all aspects of litigation, including: drafting pleadings, motions, and briefs; conducting discovery; presenting oral arguments; and handling appeals.
    Conduct factual investigations and develop legal theories for possible advocacy or litigation advancing the goals of our clients.
    Join other staff in long-term planning, strategy development, goal-setting, and work plan management that advances a collective vision for future Midwest Office work.
    Participate as an active member of a learning and mentorship culture, and engage with colleagues in a manner that is respectful, professional, and supportive.
    Participate actively in organizational and office-specific efforts to create a diverse, equitable, and inclusive workplace, and personally engage with colleagues, clients, and partners in a manner that is consistent with those efforts.
    Supervise the work of Associate Attorneys, Law Clerks, and Litigation Assistants, either as part of a litigation team or as a formal direct supervisor.
    Develop and manage relationships with co-counsel, and with a diverse group of clients and coalition partners.
    Work effectively with other departments within Earthjustice, including Communications, Development, Operations, and Policy and Legislation.

    Qualifications:
    Law school graduates who are admitted to or able join the IL Bar.
    A minimum of eight years of trial court and appellate litigation experience, including significant lead counsel experience.
    Excellent research, analysis, writing, and oral advocacy skills.
    Demonstrated ability to think strategically and to implement collective plans.
    Initiative, good judgment, a collegial work style, and a strong work ethic.
    A commitment to and passion for public interest work.
    Ability to work both independently and in collaboration with others.
    Strong interpersonal skills.
    Aware of and sensitive to the needs and concerns of individuals from diverse cultures, backgrounds, and orientations.
    Eager to help the office recruit, hire, develop, and retain a diverse and inclusive workforce.
    Ability to effectively supervise and mentor more junior staff in connection with litigation projects, and to help foster an inclusive and nurturing work environment.
    Formal management experience is a plus.
    Demonstrates an awareness and sensitivity to the needs and concerns of individuals from diverse cultures, backgrounds and orientations.

    Willing to live in the Chicago, IL area, and travel as needed.
